REQUESTING PRODUCT AND EDUCATION SEMINAR INFORMATION

We would like to thank you for showing an interest in Vivant Skin Care (Hereafter Vivant). For more information and pricing on our highly effective clinical skin care line and superior education seminars, please fill out the Account Profile form and provide a copy of your professional skin care license.

OPENING AN ACCOUNT

Vivant Skin Care allows Medical Doctors (M.D.), Registered Nurses (RN), Beauty Industry Professionals and Licensed Aestheticians to act as retailers of Vivant Skin Care products. Before an account can be established, submission of the following documentation is required:

Licensed Skin Care Professional

  1. Photocopy of your current professional license
  2. Photocopy of your government issued photo identification.
    The name must match the professional license.
    You may black out all information on the license except for the individual name and photo.
    This measure is for your protection against Identity Theft.

Responsible Party: The individual or entity legally and financially responsible for this account.

  1. Completed and signed* Account Profile form by the Responsible Party. Link to application?
    If you are an individual acting under a DBA or Fictitious Name that is not registered with your state, do not list it as a business.
  2. Signed* and Initialed Internet Policies and Trademark Agreement
  3. If you are registered in Florida and are tax exempt, you must submit your Florida Annual Resale Certificate of sales tax.

TRADESHOW PURCHASES

Purchases resulting from tradeshows or conferences do not qualify as activation of an account. The above “Opening an Account” policy must be followed in order to purchase and become an authorized Vivant Skin Care Professional. Tradeshow orders are final and there are no refunds or exchanges.

ACCOUNT ACTIVATION AND FIRST PURCHASE PROCEDURE

All of the above documentation must be submitted for processing. Incomplete submissions will not be processed. Please allow 2 business days for approval. Once your account is completed and approved, your first purchase can be placed with a Vivant Representative by calling 1-800-984-8268 within 30 days. Vivant reserves the right to select and limit the clients to distribute to.

MINIMUM ORDER

Please note that we do not have minimum order. However, when you call us at 1-800-984-8268 to place your first order of $100 or more, you will receive FREE SHIPPING. After your 1st order has been placed you may order 24 hours a day 7 days a week at www.vivantskincare.com by logging in with your email address and password.

Vivant provides four ordering options:

ONLINE WHOLESALE ORDERING

Select Vivant Skin Care Accounts with valid e-mail addresses may order online. Vivant will assign a password to all eligible accounts. Please note if you do not have a valid e-mail address we will not be able to activate your username for the online wholesale store. The e-mail address on file must match the e-mail address for the Vivant Online Wholesale Store.

LEAD TIME

Due to the high level of natural and active ingredients we do not stock large volumes. There may be a 2 to 6 week lead time. Please plan ahead accordingly.

WHOLESALE PRICING

Vivant Skin Care reviews pricing at the end of every year and strives to give Vivant Skin Care Professionals ample notice of price changes. However, prices are subject to change without notice.

SUGGESTED RETAIL PRICING

Suggested retail price is double wholesale price.

METHOD OF PAYMENT

Orders may be paid by MasterCard, Visa, American Express, and Discover.

Please ensure funds are available prior to placing the order.

Credit Cards:

  • Timing of Payment: All orders are charged prior to packing.
    Please note this charge may occur up to 48 hours before the shipment is released to carrier.

DECLINED PAYMENTS

It is the responsibility of the Vivant Skin Care Professional to ensure that funds are available prior to placing an order. A Vivant Representative will call if payment is declined. The Skin Care Professional has up to 48 hours to call back with new credit card information. If no call back; the order will be cancelled, the product will be returned to the warehouse and re-stocking fees will be applied.

LEGAL AND DEBT COLLECTION

If at any time Vivant needs to resort to such process to collect overdue accounts, legal and debt collection costs will be incurred in full by the Vivant Skin Care Professional. This includes unwarranted charge backs.

HOLDING ORDERS

Orders cannot and will not be held under any circumstances. Payment is required upon placement of order.

VERIFICATION OF ORDERS

It is critical that both the Vivant Representative and the Vivant Skin Care Professional be diligent about verifying the order. A Sales Order is final when it is faxed, e-mailed to customercare@vivantskincare.com or placed on the Vivant Online Wholesale Store. With phone orders, the Vivant Representative will read the order and the shipping address back to the Vivant Skin Care Professional. A verification code will then be given and the sale is final. Once an order is placed it cannot be amended, added on to, or cancelled. All sales are final upon placement of the order. Cancellation of full or partial orders will result in a 25% restocking fee.

PROCESSING TIME

Allow 2 full business days for an order to be processed and given to carrier for shipment; excluding weekends.

Add 7 business days for holidays, tradeshows, education seminars, and promotional sales.

SHIPPING AND HANDLING

  • F.O.B.: Freight is F.O.B. Miami, Florida
  • Free domestic Ground Shipping only on all orders over $1,000 to the Continental United States (excludes equipment). No free shipping is available for Alaska, Hawaii, Puerto Rico, US Virgin Islands or Guam.
  • Three Day Select Air, Two Day Air, or Overnight Air Service is available to phone orders only for same day shipment for orders under $1,000 and received before 2:00pm EST (11:00 am PST). If the order is over $1,000 and/or received after 2:00pm EST (11:00 am PST) it will be shipped expedited the next business day.
  • For phone, e-mail or fax orders, Shipping and Handling charges are determined at the time of processing and will be added to the invoice on all orders under $1,000. Shipping will be added and charged automatically to orders placed on the Vivant Online Wholesale Store.

SIGNATURE UPON DELIVERY

Carrier will require a signature upon delivery, unless Signature Waiver on Application Form is signed. By signing the Signature Waiver section of the Application Form, the account holder is accepting full responsibility for the shipment. For example, if the package is opened and/or stolen from the shipping address, Vivant will not be held responsible for the loss and will not replace with new merchandise.

UNDELIVERABLE AND REFUSED SHIPMENTS

In the case that an order is returned, due to it being refused or if no one is there to accept it, a 25% restocking fee plus applicable re-shipping costs will be applied to the Vivant Skin Care Professional account. New shipping charges will be incurred to re-send the shipment. Subsequent shipments will be held until the Vivant Skin Care Professional account balance is cleared.

Please contact the Customer Service Department with all of your concerns regarding complaints.

When sending an e-mail or calling, have the invoice #, lot #, product size, a brief description, and the best time and phone number to reach you.

DAMAGED SHIPMENT

Product damaged in shipment must be reported to Vivant within 48 hours from the delivery date. Be sure to keep the damaged products in the original shipping carton. Vivant will send a replacement of the damaged products only, no substitutions or additional discounts. Vivant will contact carrier to schedule the required carrier damage inspection and claim for reimbursement. The Vivant Skin Care Professional must return damaged goods with the provided Return Authorization (RA) within 15 days. If products are not returned, the product costs will be applied to the Vivant Skin Care Professional’s account.

RETURN AUTHORIZATION (RA)

All returns, regardless of reason, need a Return Authorization (RA). Unauthorized returns will be discarded and no credits issued. Call Customer Service to obtain a Return Authorization (RA). Return Authorization (RA) expires 15 days from the issued date.

VIVANT CREDIT ONLY

Refunds will be issued in the form of a credit to the Vivant Skin Care Professional’s account. No cash, check or credit card refunds will be issued.

EXPIRED PRODUCT

Returns on expired items will not be accepted as they are not eligible for refund. The Vivant Skin Care Professional is responsible for rotating and maintaining their stock.

RETURNS

Returns for any reason, other than defect, must be made within 30 days from receipt of the order and are subject to a 25% restocking fee. Vivant Skin Care Professional is responsible for the return shipping charges. Lot # must be provided to customer service. Product must be resalable, unopened, unused, no stickers, scratches or other defining marks with a copy of the RA issued. Returns made in compliance with this policy will receive a credit issued to the Vivant Skin Care Professional’s account. No additional discounts will be given.

DEFECTIVE PRODUCT

The quality of our products is of utmost importance. Although defects are rare, we need to know at once if there is one. Call Customer Service with a brief explanation and lot # of the product to receive a RA. Once the product is received, we will send the product out to be tested by the lab. Please allow at least 2 weeks for a response. Please note that expired product is not considered defective.

REQUIRED CONDITION OF STORAGE

Due to the high level of natural ingredients and active ingredients in Vivant’s products, they must be stored in a climate controlled environment (50-78°F), away from direct sun exposure and dampness. Some products require refrigeration. Containers must be tightly closed at all times when not in use to avoid damage from humidity and oxidation.

USE OF VIVANT PRODUCTS

Only authorized providers are permitted to use and sell Vivant Skin Care. Retail products are the only permissible items to be sold to the Vivant consumer. Professional Use Only products are prohibited to be sold. No responsibility will be accepted by Vivant Skin Care for untrained or unqualified personnel using or misusing any products supplied.

CONSUMER RETURNS

The best way to avoid consumer returns is to thoroughly educate your clients on the proper use of Vivant products. However, if you do receive a return, please accept it graciously. Call Customer Service to obtain a RA (Return Authorization).

The returned product must be sent to Vivant within 15 days of the consumer return, accompanied by the consumer sales receipt, and a brief explanation. A credit will be issued to the Vivant Skin Care Professional’s account. No additional discounts will be given. Please note that you will receive a credit for the wholesale price, not the retail price, shipping costs, or taxes charged to the consumer.

INTERNATIONAL SALES

Selling and/or shipping of Vivant products outside the USA is strictly prohibited. Any Domestic wholesale account found to be shipping products outside of the USA will be terminated immediately and without notice. Likewise, any International account that reintroduces Vivant products back into the United States for sale will be terminated.

ADVERTISING

Advertising images are available to select Vivant Skin Care Professional accounts. Please be aware that all advertising must be approved by Vivant Skin Care before publishing. Publishing advertisements without prior approval may result in termination of your account. The Trademark Agreement can be obtained through the Vivant Marketing Department at marketing@vivantskincare.com (add link).

TRADEMARK USAGE

The name “Vivant”, its logos and images are trademarks of Vivant Skin Care, LLC. As a member account in good standing, you have the right to use the name, logos, and images to promote your business. This includes advertising, promotional materials, business stationary, business cards, and temporary signage (i.e. door & window signs) as long as such use is in conjunction with or in reference to Vivant products and treatments. Any use of the name, logo or images for the promotion of any other products or treatments is strictly prohibited. If for any reason your relationship as a wholesale account for Vivant products is terminated, you agree to discontinue using the above referenced name, logos or images immediately. If you are interested in utilizing Vivant images please request a Trademark Agreement from the Vivant Marketing Department at marketing@vivantskincare.com.

EDUCATION SEMINARS

Education seminar topics, dates and locations are subject to change. The registration fee is non-refundable. Courses may be cancelled by Vivant if there are insufficient registrants. In this event, the registration fee will be credited to the Vivant Skin Care Professional’s account. Accommodations cannot be made for allergies, including food and latex allergies. Reprints of Attendance Certificates are $15.00, regardless of whether they were lost, damaged or stolen. Vivant is not responsible for travel, lodging or monetary expenses incurred should an education seminar be cancelled.

E-MAIL COMMUNICATION

Vivant uses e-mail as our primary means of communication. If we do not have your current e-mail address you will not be notified of important company information nor have access to Vivant’s Online Wholesale Store. Unfortunately, Vivant cannot make any exceptions and will not be held responsible for information, such as policy changes and announcements that the Vivant Skin Care Professional did not receive. INACTIVE ACCOUNTS

A Vivant Skin Care Professional account will be made inactive if there is no sale made within 12 months.

These conditions are final and no verbal or written representation by any employee, director or consultant of Vivant Skin Care, LLC will be deemed to have altered them.

Any order, whether written or verbal, now or at any time in the future, will be subject to these conditions even if such orders are placed by an employee or agent of the buyer.

Vivant reserves the right to make changes to the policies and procedures to insure the orderly operation of its business.

Vivant reserves the right to suspend sales or close the account of any customer who fails to comply with these policies, terms and conditions without notice.
